TERMS AND CONDITIONS (“T &C”)

These T &C apply to every purchase made on www.refilis.com (the “Site”). By accessing the Site, creating an account, or placing an order you accept (i) these T &C, (ii) our Privacy Policy, and (iii) our Cookie Policy. If you do not agree, do not use the Site.

2. SCOPE, MARKET LIMITS, AND CONTRACT LANGUAGES
2.1 We currently sell and ship only to the European Union, Norway, Iceland, Liechtenstein, United Kingdom, Switzerland and Australia (collectively “Covered Markets”).
2.2 Contract languages: English, Italian, German, French, Spanish, Swedish. If a conflict arises, the English text prevails unless mandatory local law requires otherwise.
2.3 Mandatory consumer rights under the law of your country of residence remain unaffected.
3. PRODUCTS AND CONTRACT FORMATION
3.1 Goods are sold for personal, non-commercial use only.
3.2 Your order is an offer. A binding contract forms when we dispatch the goods and send you a shipping-confirmation e-mail.
3.3 We may refuse or cancel an order in cases of suspected fraud, stock error, payment failure, sanctions compliance, or export restrictions.
4. PRICES, TAXES, DUTIES, AND PAYMENT
4.1 Prices appear in your local currency where available; otherwise in EUR.
4.2 EU/EEA/UK prices include VAT (charged under IOSS/OSS where applicable). Swiss prices are shown gross of customs duties (no Swiss VAT charged by us). Australian prices are GST-exclusive; GST and import fees are due on delivery unless stated “DDP” at checkout.
4.3 Whenever we show a discount we display the lowest price offered in the 30 days preceding the reduction (EU Omnibus rules, applied voluntarily to UK, CH, AU).
4.4 We do not personalise prices based on automated profiling.
4.5 Secure payment is processed by Stripe, PayPal or comparable providers. Your card or account is charged immediately.
5. SHIPPING AND DELIVERY
5.1 Handling time: 1-3 business days after order acceptance.
5.2 Transit time: 7-12 business days (Mon–Fri) from dispatch for all Covered Markets.
5.3 We e-mail you a tracking link when we ship.
5.4 Import duties, GST, VAT on import, brokerage and customs delays outside the EU are the customer’s responsibility unless we clearly state “Delivered Duty Paid (DDP)” in the checkout summary.
5.5 Delivery within the EU/EEA/UK will in any case occur no later than 30 days after contract formation unless you agree otherwise.
6. RETURN POLICY AND STATUTORY WITHDRAWAL RIGHTS
6.1 90-Day Extended Return: You may return unused, undamaged items within 90 days of delivery for any reason. Contact support@refilis.com before shipping the return. You pay return postage unless the item is defective or incorrect.
6.2 Statutory Cooling-Off (does not limit clause 6.1):
• EU/EEA and UK: 14 days from delivery to withdraw without reason.
• Switzerland: no statutory cooling-off right, but our 90-day policy applies.
• Australia: no mandatory change-of-mind right; ACL consumer guarantees apply (see clause 7).
6.3 We refund the original payment method within 5-10 business days of receiving the return. We may deduct for missing parts or damage.
6.4 The EU/UK model withdrawal form and standard instructions appear in Annex 1.
7. LEGAL WARRANTY AND STATUTORY GUARANTEES
7.1 EU/EEA and UK: goods are covered by a 2-year legal guarantee of conformity beginning on the delivery date.
7.2 Switzerland: legal warranty under Swiss Code of Obligations (art. 197 ff.) lasts 2 years.
7.3 Australia: “Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.”
7.4 To claim, e-mail support@refilis.com with order number, description and photos.
8. LIABILITY
8.1 Nothing in these T &C limits or excludes liability for (a) death or personal injury caused by negligence, (b) fraud, or (c) any liability that cannot be limited or excluded by mandatory law.
8.2 For breach of essential contractual duties caused by simple negligence, liability is limited to typical, foreseeable damage.
8.3 We are not liable for indirect or consequential loss, lost profits, or data loss unless prohibited by mandatory law.
8.4 Aggregate liability per order is limited to the total amount you paid for the goods concerned, except where mandatory law provides otherwise.
9. INTELLECTUAL PROPERTY
All content on the Site – text, images, code, trademarks and logos – is owned by Trade Charls LLC or its licensors. Unauthorised use is prohibited.
10. PRIVACY AND COOKIES
We process personal data in accordance with the GDPR, UK GDPR, Swiss FADP and Australian Privacy Act. For details and your rights, see our Privacy Policy. The Cookie Policy explains how we use cookies and how you can manage consent; a banner appears on first visit.
11. SUBSCRIPTIONS AND AUTOMATIC RENEWALS
If you buy a subscription, the term, renewal price and cancellation method are shown at checkout. You may cancel at any time through your account dashboard or by e-mail; cancellation is as easy as signing up.
12. EXPORT AND SANCTIONS COMPLIANCE
You must not purchase if you are subject to trade sanctions. We may cancel any order that would breach sanctions or export-control laws.
13. GOVERNING LAW AND DISPUTE RESOLUTION
13.1 Consumers may sue in the courts of their country of residence. Mandatory consumer-protection law of that country applies; otherwise Texas law (USA) governs.
13.2 Non-exclusive jurisdiction: courts of Travis County, Texas, USA.
13.3 EU/EEA and UK consumers may submit disputes via the EU ODR platform: https://ec.europa.eu/consumers/odr. We will consider alternative dispute resolution in good faith.
14. CHANGES TO THESE T &C
We may update these T &C. The version shown on the Site at the moment of purchase applies to that purchase. Previous versions are archived; contact us for a copy.
